The Managerial Personality of Artificial Intelligence in the Context of the Labour Law

The study I authored, titled “The Managerial Personality of Artificial Intelligence in the Context of the Labour Law”, has been published as a chapter in the volume “Social Sciences in Theory and Practice 2”.

This book chapter addresses the legal status within the context of labour law, and the associated legal challenges, of artificial intelligence (AI) systems increasingly utilised by employers in decision-making processes. The study first delineates the legal boundaries of the concepts of “employer” and “employer’s representative”. Subsequently, it discusses whether AI falls under the categories of “natural person”, “legal person”, or the proposed “electronic personality” within the Turkish legal system. Through an examination of theoretical approaches classifying AI as “property”, “slave”, or “legal person”, the study concludes that, under the current legal framework, AI cannot acquire the status of an employer or an employer’s representative; rather, it remains legally characterised as an instrument dependent on the employer. Consequently, the study emphasises that the ultimate legal liability arising from decisions made by AI in processes such as recruitment, performance evaluation, or termination of employment rests with the employer, highlighting the employer’s obligation to supervise these technological tools.
